For as long as you are a customer of Avalara AvaTax, if you ever suffer a negative audit finding and financial loss related to an inaccurate result returned by the Avalara service, we will pay your uncollected tax, penalty and interest, or refund your prior 12 months’ service fee, whichever is lower.*
*If you have a negative audit finding and financial loss related to an inaccurate result, we will pay your penalty and interest for the period in which the error occurred, or refund the prior 12 months’ service fee, whichever is lower, provided that you have:
(1) properly set up and configured the AvaTax system; (2) notified Avalara of a documented audit finding within 10 days of your first knowledge of such finding; (3) assisted Avalara in confirming the occurrence of the error, including providing Avalara with access to your logs, reports and other records; (4) assisted Avalara in challenging the taxing authority determinations if Avalara determines them to be incorrect; (5) You cooperate in mitigating your losses after the negative audit finding; and you collaborate with Avalara to rebill your customer for the uncollected tax.
This guarantee only applies to sales tax calculation results provided by the AvaTax Service after October 15, 2015.
